SiteWatch.pro – Legal Conditions (Founder Preview)

These transparent, plain-English terms summarize your rights and obligations for the Founder Preview of SiteWatch.pro, operated by Cyze AS, Norway (Org No. 932904500). Please read carefully — by signing up, you acknowledge and accept these terms.

1. Service Commitment & Availability

Service Level Objective (SLO):

We strive to maintain 99.5% uptime for our core monitoring services, measured monthly. The Founder Preview of SiteWatch.pro is provided “as is” and on a best-effort basis. While we commit to this objective, no compensation or service credits will be provided for downtime during this Founder Preview period.

Scheduled Maintenance:

We may perform scheduled maintenance that may temporarily impact service availability. We will endeavor to provide reasonable advance notice of such maintenance (e.g., via email or service status page) and schedule it during off-peak hours where practicable. Downtime due to scheduled maintenance is excluded from the SLO calculation.

Check Frequency & Precision:

The frequency and precision of website checks (e.g., 1-minute intervals with ±5 seconds tolerance) are determined by your selected package.

Limitation of Liability for Service Issues:

Cyze AS is not liable for any direct or indirect damages, including but not limited to, missed, delayed, or duplicate alerts; system errors; reputation loss; or revenue loss, arising from any interruption, delay, or unreliability in the service. This includes any failure to meet the stated Service Level Objective, except for downtime excluded as per this section.

2. Who May Use SiteWatch.pro

Ownership/Control Warranties:

You must own, operate, or possess control/authority to monitor any website added to SiteWatch.pro — this service is strictly for site owners, agencies, or those with legal rights (e.g., agencies managing client sites).

For advanced (“offensive” or vulnerability scanning) features: explicit written consent, or domain TXT DNS record verification, is mandatory.

Prohibited Use:

No monitoring of illegal or “dark web” sites (e.g., drugs, child exploitation, criminal activity). Such attempts may be reported to authorities.

No use on sites dedicated to espionage or prohibited activity.

Automated Use:

Automation, bots, AI, or scripts interacting with SiteWatch.pro (other than those officially supported or via approved APIs) is strictly forbidden.

3. Package, Retention & Grandfathering Policies

Founder Preview:

The “Founder Preview” package, including its grandfathered price and terms, is valid for a maximum of 12 months.

Upon the conclusion of this 12-month period, your subscription will automatically transition to a new standard plan, unless you actively cancel your service before the transition date. We will provide multiple clear notifications regarding this upcoming transition and the new plan details well in advance, including instructions on how to manage or cancel your subscription.

4. Termination & Suspension

We may terminate or suspend your account and deny access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

5. Payments, Cancellation & Refunds

Payments:

All billing and auto-renewal are handled by Stripe. Access to active monitoring and related services will be suspended until payment is confirmed.

Refund Policy:

For new subscription terms, you may request a full refund of your initial payment within the first 30 days of that term. Refunds are not provided for renewed subscription terms.

Auto-Renewal:

Stripe controls renewal/cancellation; users must manage their subscriptions and billing directly via Stripe.

Cancellation:

Cancel any time. Service and access end upon subscription expiry; data is deleted unless required by law.

6. Limits of Liability

Liability Cap:

Cyze AS’s total liability to you for any and all claims arising from this service is capped at the amount you paid in the preceding 12 months. There is no liability for:

7. Acceptable Use & User Commitments

Intellectual Property

The Service, its original content, features, and functionality (including but not limited to all software, code, algorithms, design, text, graphics, logos, and the trademark “SiteWatch.pro”) are and will remain the exclusive property of Cyze AS and its licensors. The Service is protected by copyright, trademark, and other laws of both Norway and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Cyze AS. All rights not expressly granted to you herein are reserved by Cyze AS.

Lawful Use Only:

You agree not to use SiteWatch.pro to monitor prohibited content, impersonate others, or break any laws.

True Information:

You warrant the information you provide is accurate and you have the right to “watch” the websites you add.

Your Obligations for Security Features:

For pentest/vulnerability-oriented scans, explicit proof of authority is required.

Reverse Engineering & Abuse:

You must not attempt to reverse-engineer, interfere with, or abuse the service in any way.

Trademark:

The “Monitored by SiteWatch.pro” badge may be used on your site if you wish, but branding and trademark use must respect Cyze AS guidelines.

Indemnification

Your Indemnification

You agree to indemnify, defend, and hold harmless Cyze AS from any and all claims, damages, losses, and expenses (including legal fees) arising out of or in connection with your use of the Service, your breach of these Terms, or your violation of any third-party rights.

Our Indemnification

We will indemnify, defend, and hold you harmless from any third-party claims that the Service, as provided by us, infringes upon any intellectual property rights of that third party, provided you promptly notify us of the claim and cooperate with us in the defense. We will not be liable for any infringement caused by your use of the Service in a manner not authorized by these Terms or in combination with other software or services not provided by us.

Open Source & Attributions:

We use open-source software (e.g., The Rust Programming language, diesel.rs, tokio.rs, astro.build, and many others). A full list of OSS attributions is available upon request.

8. Feedback & Feature Requests

Users are welcome and encouraged to submit feature requests or join our roadmap discussions. Submitting feedback conveys no right to compensation or co-ownership.

9. Data Rights & Retention.

Data Usage:

All system-generated data (probe results, uptime logs, reports) is owned by Cyze AS but licensed to the user during their paid subscription. Manually entered info (e.g., user profile, contact email) remains user-controlled.

Data Retention & Usage After Termination:

Data is retained per your current plan duration. Upon account termination, all Personally Identifiable Information (PII) associated with your account will be deleted, except where retention is required by law or tax regulations.

We reserve the right to retain certain non-personally identifiable data (such as aggregated probe results, anonymized uptime logs, and statistical reports) after account termination. This data is used solely for internal purposes, including service improvement, analytics, and product development. Such retained data cannot be guaranteed to be available again should you decide to resume service. For more details on our data handling practices, please refer to our Privacy Policy.

No Export Guarantee:

There is no built-in right to bulk data export unless provided explicitly by the product. (This is a Founder Preview, and we may add this in the future.)

10. Policy Updates & Versioning

Change Policy:

We may update these terms and will notify you at least 30 days before changes take effect. Archived/superseded versions are retained for audit purposes.

User Acceptance:

Continued use indicates acceptance of updated terms. Significant updates may require re-acceptance to continue.
